Generally, the vehicle must have a substantial defect covered by warranty that the dealer cannot fix after a reasonable number of attempts, or the car must be out of service for an extended stretch of time. Cosmetic or minor issues usually do not qualify. An attorney will compare your repair history against Delaware's specific standard.

Delaware's lemon law is aimed at new vehicles, so many used purchases fall outside it. That is not the end of the road, though. A remaining factory warranty, a dealer service contract, or claims for misrepresented condition or undisclosed accident history can still support a case, and those are worth having reviewed.

Delaware sets deadlines that vary, and lemon law claims also have coverage windows measured from delivery in mileage or time that can close even sooner. Repair attempts made after those windows may not count. Have a Delaware attorney review your purchase date and repair orders early so the exact deadline is confirmed.

Under 6 Del. C. § 5003, a vehicle is presumed a lemon if, within 1 year, the manufacturer cannot repair a substantial defect after 4 or more attempts, or the vehicle has been out of service for 30 cumulative days. The defect must substantially impair the use, value, or safety of the vehicle.

Delaware’s Lemon Law applies only to new vehicles. The federal Magnuson-Moss Warranty Act and the Delaware UCC implied warranty of merchantability protect used buyers with a written warranty.
