Save every repair order, invoice and loaner record, your purchase contract and warranty, and any letters to the manufacturer. Count days out of service and repair attempts carefully, because those numbers determine eligibility. If the dealership has not provided complete records, an attorney can demand them.
If the manufacturer offers a qualifying dispute resolution program, Kansas generally expects you to use it first. Many claims resolve there with a repurchase or replacement. If that does not work, a lawsuit can be filed in Sedgwick County, and an attorney can represent you at both stages.
Under K.S.A. § 50-645, a vehicle is presumed a lemon if, within 1 year or 12,000 miles, the manufacturer cannot repair a nonconformity after 4 attempts, or the vehicle has been out of service for 30 cumulative days.
Kansas’s Lemon Law applies only to new vehicles. The federal Magnuson-Moss Warranty Act and the Kansas UCC implied warranty of merchantability protect used buyers with a written warranty.
