Generally, a new vehicle with a substantial defect that the dealer cannot fix after a reasonable number of repair attempts, or one out of service for repairs for an extended period within an early coverage window. The defect must materially affect use, value, or safety. An attorney can assess whether your repair history qualifies.

Keep every repair order, including dates in and out, mileage, and the complaint you reported each time, plus your purchase or lease paperwork and any written communication with the dealer or manufacturer. Verbal complaints with no paperwork are the most common reason strong claims fall apart.
