Texas handles most lemon law complaints through a state agency rather than court. You file a complaint, and a hearing examiner can order a repurchase or replacement if the vehicle qualifies. An attorney prepares the complaint, organizes repair records, and represents you at the hearing.
The state lemon law primarily covers new vehicles with defects reported during the warranty period, though some used vehicles still under the original warranty may qualify. Federal warranty law may help otherwise. An attorney reviews your purchase and repair history to determine options.
Each visit still counts as a repair attempt if you reported the defect, so document every trip, including dates and what you reported. Keep all repair orders. An attorney uses those records to show the manufacturer had a reasonable opportunity to fix it.
Under Tex. Occ. Code § 2301.605, a vehicle is presumed a lemon if, within 24 months or 24,000 miles, the manufacturer cannot repair a nonconformity after 4 attempts (2 for serious safety defects), or the vehicle has been out of service for 30 cumulative days.
