How we match your Virginia Beach workers' compensation case

When you submit a Virginia Beach workers' compensation matter, we route it through a national network of independent partner firms and put it in front of the one that fits best — based on the kind of case it is, what it is likely to involve, where it has to be handled, and who has capacity to take it on now.

  1. Case type

A workers' compensation matter needs someone who handles workers' compensation work day to day, not a generalist. Practice area is the first filter.

  2. Size and complexity

Some firms are built for catastrophic injury and multi-party litigation; others resolve straightforward claims quickly. We weigh what your matter is likely to involve against how each firm actually works.

  3. Jurisdiction and licensing

Your matter is decided under Virginia law, so it goes to an attorney licensed in Virginia who regularly appears where your case would be heard.

  4. Capacity and fit

Availability, conflicts of interest and language all matter. If the best-fit firm cannot take your case, we route it to the next one that can — or tell you plainly when no one in the network is the right answer.

Every partner reviews your case for free. Injury and workers’ compensation matters are handled on contingency — no fee unless you win. Other matters are quoted upfront, before you commit to anything.

DearLegal provides marketing and matching services and is not a law firm. Submitting a case does not create an attorney-client relationship. Matches depend on case type, jurisdiction and firm availability.

More about legal help in Virginia Beach

Hotel and restaurant staff, construction crews, shipyard workers commuting to Norfolk and Portsmouth, health care employees, and civilian defense workers fill Virginia Beach’s workplace injury docket. Virginia’s workers’ compensation system covers medical care and wage benefits without proving fault, but disputes go to the state compensation commission rather than the city’s courts, and the system favors employers, so denials are common. Federal employees and some maritime workers follow separate rules. DearLegal matches you with a Virginia-licensed attorney who handles workers’ compensation cases in Virginia Beach, with a free review.

  • Workers’ comp disputes from Virginia Beach go to the state compensation commission, not the city’s courts.
  • Hospitality, construction, and shipyard commuters to Norfolk and Portsmouth drive Virginia Beach claims.
  • Virginia’s system tends to favor employers, so denied Virginia Beach claims often need an attorney.

Most Virginia workers' compensation attorneys work on contingency: the fee is a share of what they recover, and nothing if they don’t.

Virginia caps workers' comp attorney fees at 25% of recovery under Va. Code § 65.2-714, subject to Commission approval. LHWCA fees on Newport News Shipbuilding claims and DBA fees on federal-contractor claims may be employer-paid. Third-party tort claims (motor vehicle, product liability, contractor) run outside the comp system on standard 33%–40% personal-injury contingency.

Not in the city’s courts. Disputes over benefits go before Virginia’s workers’ compensation commission, which has its own procedures and hearing officers. An attorney who regularly appears there can file the claim, present medical evidence, and appeal an unfavorable decision.
Generally, ordinary carelessness doesn’t defeat a workers’ comp claim; the system is no-fault. There are exceptions for intoxication and willful safety violations. Virginia’s system is tougher on workers than many, so a denial is worth having a Virginia attorney review promptly.
Report it to your employer as soon as possible, in writing, and file a claim with the commission within the time Virginia allows, which is limited. Late reporting is a common reason for denial. An attorney can make sure the claim is filed properly and on time.
Notice within 30 days under Va. Code § 65.2-600. The Claim for Benefits must be filed within 2 years of injury under § 65.2-601. Occupational disease has separate timing rules under § 65.2-406.
The employer provides a panel of three physicians under Va. Code § 65.2-603, from which the worker selects the treating physician. Going outside the panel without authorization typically means the bills aren't covered.
