The CCP § 364 Notice of Intent tolls the SOL by up to 90 days in some circumstances.

As of January 2026, the cap is roughly $430,000 for personal-injury cases and $600,000 for wrongful death, with annual increases through 2033 to $750,000 / $1,000,000, followed by 2% annual inflation adjustments. Up to three separate caps can apply in multi-defendant or multi-category cases. Economic damages remain uncapped.
