How we match your Bonita Springs lemon law case

When you submit a Bonita Springs lemon law matter, we route it through a national network of independent partner firms and put it in front of the one that fits best — based on the kind of case it is, what it is likely to involve, where it has to be handled, and who has capacity to take it on now.

  1. Case type

A lemon law matter needs someone who handles lemon law work day to day, not a generalist. Practice area is the first filter.

  2. Size and complexity

Some firms are built for catastrophic injury and multi-party litigation; others resolve straightforward claims quickly. We weigh what your matter is likely to involve against how each firm actually works.

  3. Jurisdiction and licensing

Your matter is decided under Florida law, so it goes to an attorney licensed in Florida who regularly appears where your case would be heard.

  4. Capacity and fit

Availability, conflicts of interest and language all matter. If the best-fit firm cannot take your case, we route it to the next one that can — or tell you plainly when no one in the network is the right answer.

Every partner reviews your case for free. Injury and workers’ compensation matters are handled on contingency — no fee unless you win. Other matters are quoted upfront, before you commit to anything.

DearLegal provides marketing and matching services and is not a law firm. Submitting a case does not create an attorney-client relationship. Matches depend on case type, jurisdiction and firm availability.

More about legal help in Bonita Springs

Long commutes up I-75 and US 41 to Fort Myers and Naples, plus salt air and summer heat, put hard miles on new vehicles bought by Bonita Springs drivers, and a heavy retiree market here means plenty of new cars, trucks, and motorhomes under warranty. Florida's lemon law covers new vehicles within a limited period after delivery and requires you to give the manufacturer a chance to repair, often followed by a state-run arbitration program before any suit in Lee County Circuit Court. DearLegal matches you with a Florida-licensed attorney who handles lemon law cases in Bonita Springs, with a free review.

  • Florida's lemon law applies to new vehicles within a limited window after delivery and requires notice to the manufacturer plus a reasonable chance to repair.
  • Disputes commonly go through Florida's state-administered arbitration process before a lawsuit is filed in Lee County Circuit Court.
  • Used and out-of-window vehicles are usually handled instead under warranty, dealer fraud, or federal warranty law rather than the lemon statute.

In Florida lemon law cases the law can shift your attorney’s fees to the other side — you keep your recovery.

Florida’s Motor Vehicle Warranty Enforcement Act (Fla. Stat. § 681.112) and the federal Magnuson-Moss Warranty Act (15 U.S.C. § 2310(d)(2)) are fee-shifting — the manufacturer pays the prevailing consumer’s reasonable attorney fees on top of the recovery. Most Florida lemon law attorneys take cases with no fee deducted from the consumer’s refund or replacement.

Generally the vehicle must be new, have a defect that substantially impairs its use, value, or safety, and continue to fail after the manufacturer has had a reasonable number of repair attempts or has kept it out of service for an extended time. Written notice to the manufacturer is a required step. An attorney can tell you whether your repair history qualifies.
Florida routes most new-vehicle lemon disputes through a state-administered arbitration program, and manufacturers with a certified program of their own may require that first. Arbitration can be faster than court and awards can include a refund or replacement. If it does not resolve things, a case can proceed in Lee County Circuit Court.
Florida sets deadlines that vary, including a limited eligibility period measured from delivery of the vehicle and separate time limits for filing arbitration or suit. These are strict, and repairs continuing past the window do not automatically extend it. Have a Florida attorney confirm your exact deadline as soon as the problem repeats.
Under Fla. Stat. § 681.104, a vehicle is presumed a lemon if, within 24 months of delivery, the manufacturer cannot repair a nonconformity after 3 attempts, or the vehicle has been out of service for repairs for 30 cumulative days (15 of which must occur during the “Lemon Law rights period”).
Florida’s Lemon Law applies only to new vehicles. The federal Magnuson-Moss Warranty Act and Florida’s UCC implied warranty of merchantability (Fla. Stat. § 672.314) protect used buyers with a written warranty.
