Florida’s lemon law includes an arbitration program that many cases go through first, and sometimes a manufacturer’s own program applies. An attorney will explain the order of steps, prepare your claim for arbitration, and take the case to Broward County court if the result is unsatisfactory.
Keep every repair order showing the date, mileage, complaint, and work done, plus written communications with the dealer and manufacturer. Note how many days the vehicle was unavailable. Florida’s deadlines run from delivery, so a lemon law attorney will review your paperwork early.
Under Fla. Stat. § 681.104, a vehicle is presumed a lemon if, within 24 months of delivery, the manufacturer cannot repair a nonconformity after 3 attempts, or the vehicle has been out of service for repairs for 30 cumulative days (15 of which must occur during the “Lemon Law rights period”).
Florida’s Lemon Law applies only to new vehicles. The federal Magnuson-Moss Warranty Act and Florida’s UCC implied warranty of merchantability (Fla. Stat. § 672.314) protect used buyers with a written warranty.
