Illinois’ state lemon law primarily covers new vehicles within a limited period, but used vehicles under warranty may still have claims under federal warranty law or other Illinois protections. An attorney reviews your purchase and repair history to determine which laws apply and what remedies are available.
Illinois presumes a vehicle is a lemon after a set number of unsuccessful repair attempts for the same defect or a set number of days out of service within the coverage period. The exact thresholds depend on your situation. Keep all repair orders and an attorney will confirm.
Illinois generally requires you to use the manufacturer’s arbitration program first if one exists, before going to court. The decision is not binding on you. An attorney prepares the arbitration case and, if the result is unsatisfactory, pursues the claim in Cook County.
Under 815 ILCS 380/3, a vehicle is presumed a lemon if, within 12 months or 12,000 miles, the manufacturer cannot repair a nonconformity after 4 attempts, or the vehicle has been out of service for 30 cumulative business days.
Illinois’s Lemon Law applies only to new vehicles. The federal Magnuson-Moss Warranty Act and the Illinois UCC implied warranty of merchantability protect used buyers with a written warranty.
